After a long wait, Punjab & Haryana High Court has ordered to remove the illegal banquet hall erected on the ground of Sector 29 Huda Gymkhana Club, by 9 May, 2019.
In its order of April 8, 2019, the High Court Judge, Raj Mohan Singh directed Billu Tent House to remove all the articles from the banquet hall and handover the bare ground to Haryana Shehri Vikas Pradhikaran (HSVP) within 4 weeks ie May 9, 2019. Failing this, HSVP would be entitled to confiscate the remaining articles besides exercising right to take lawful action against Billu Tent House.
According to the agreement signed between Huda Gymkhana Club and Billu Tent House on 21 September, 2017, the club was to bear a loss of upto Rs.45,00,000/-. Accordingly, Huda Gymkhana Club paid Rs.20,05,186/- to Billu Tent House in the court room and adjusted Rs.24,94,814/- due to Billu Tent House. As such Huda Gymkhana Club paid a compensation of Rs.45,00,000/- to Billu Tent House.
Addressing the media persons, Advocate Abhay Jain, Convener Manav Awaaj and member Huda Gymkhana Club and Jagat Yadav,Secretary of the organization and other club members told that it was rather unfortunate that club members had to approach High Court thrice to get justice against this scandal. Along with them, other club members including Kalyan Singh Sharma (Retd. IRS), Banwari Lal Saini, Kulbir Singh Sirhon, Dharamvir, Raspal Singh, Neeraj Saluja, R K Saini, Ajit Sharma, O P Dhiya, Ashwani Dabra, Yogesh Dabra, S K Bedi, Capt Raj Chopra, Sanjay Jain, Sahmmi Ahlawat, Anil Yadav, Hemant Vashist, Y R Dhingra, Rishabh Jain played significant role.
It may be mentioned that in 2017, Manav Awaaj and club members had exposed this Rs.110 crore scam in which the permission to set up banquet hall on the ground of Huda Gymkhana Club was illegally given to Billu Tent House.
Throwing all rules to the wind, the then club President and Huda Administrator, Yashpal Yadav and General Secretary of the club and HUDA Estate Officer-2, Vivek Kalia had given 11221 yards of land on lease in club ground at throwaway prices, without calling any tender or advertisement. The said land was given on 9 years lease for a paltry sum of Rs.35,00,000/- per year against the official rent of Rs.12.58 crore a year, causing a loss of Rs.110.15 crore to the club.
After exposing this big scam, Manav Awaaj and members of Huda Gymkhana Club had appealed to highest authorities and the court to scrap this dubious deal. Billu Tent House approached the lower court for stay which was rejected by Judge Abhishek Phutela. Later,Sessions Court was approached but on 28 January, 2018, the judge Sandeep K. Duggal declined to grant the stay. The case however took a new turn when the matter went to Punjab & Haryana High Court.On 30 May, 2018, the court appointed Ratan Lal as an Evaluator, asking him to submit his report about the evaluation of banquet hall and its items within two weeks. Meanwhile, the banquet hall was continuously given on rent for VVIP functions.
When no progress on evaluation report was made, club members again approached High Court, which appointed a new evaluator, Surinder Kumar.
In July last year, however the banquet hall was sealed by the authorities.
It may be noted that on the demand of Manav Awaaj and club members, two separate enquiries against the officials involved in this Rs.110 crore scam conducted by State Vigilance Bureau and CEO of Gurugram Zila Parishad are still going on for a long time.
