In a setback to the Centre the Supreme Court today refused to stay its order of March 20 where it had stated that immediate arrest cannot be made under SC/ST Act. The apex court clarified that it had not diluted any substantive provisions of the SC/ST Act and said that that the victims had the right to get compensation. The SC also added that it would not go back on its order and that it had only said that what it has done is to save innocent people from arrests. The Centre’s review petition was heard by original bench of Justice Goel and Justice Lalit after AG Venugopal pointed to large scale violence by the Dalit organizations, wherein several people lost their lives.
The SC’s order of March 20 had meant that the accused should be provided bail unless expressly proved that he was an offender.
